ACCESS TO AND USE OF THE SUN SITE(tm) Server IS SUBJECT TO THE
FOLLOWING TERMS AND CONDITIONS:
Please note, by submitting any software, documentation or other
material ("Materials") for installation on the Sun SITE Server,
the owner of the proprietary rights in those Materials
affirmatively grants to any user of the Server the right to
freely copy, use, modify or distribute the Materials except as
otherwise specified in this Notice, and subject to any express
restrictions included with the Materials by the owner.
The ownership and all proprietary rights (including trademarks,
copyrights and patents) in such Materials shall remain with the
owner of those rights. Neither the University of Alberta
("ServerSite") nor Sun Microsystems ("Sun") are responsible for
providing notice of or enforcing any such restrictions. All
parties submitting Materials to the Sun SITE Server represent
and warrant to ServerSite and Sun that the submission,
installation, copying, distribution, and use of such Materials
in connection with the Sun SITE Server will not violate any
other party's proprietary rights or laws in effect within the
U. S. or their own local laws. Materials on the Server may not
be used for any commercial purpose, and may not be distributed
for any fee or other charge except to defray actual costs
incurred by the distributor.
Neither ServerSite nor Sun are responsible for any errors
created in or damage to the Materials as a result of their
installation or maintenance on the Server, or their use by
anyone accessing the Server.
The Sun SITE Server and all Materials maintained on the Server
are provided "as is" with no warranties of any kind.
SERVERSITE AND SUN DISCLAIM ALL EXPRESS WARRANTIES INCLUDED IN
ANY MATERIALS, AND FURTHER DISCLAIM ALL IMPLIED WARRANTIES,
INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR
PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.
Materials may not be used for any purpose requiring fail-safe
performance, or where defects in or failure of Materials could
cause death, personal injury, or property or environmental
damage ("High Risk Activities").
SERVERSITE AND SUN DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES
WITH RESPECT TO HIGH RISK ACTIVITIES. NEITHER SERVERSITE OR SUN
SHALL BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING
CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING FROM THE SUBMISSION,
INSTALLATION, MAINTENANCE, TRANSMISSION, COPYING, MODIFICATION,
DISTRIBUTION OR ANY USE OF ANY MATERIALS.
Information appearing on the Sun SITE Server may be subject to
U.S. or local export control laws or regulations and users must
comply with any and all such laws or regulations.
